The Homeowners Assistance Program (HAP) is authorized by Section 1013 of the Demonstration Cities and Metropolitan Development Act of 1966, as amended. The Act authorizes the Secretary of Defense to provide financial aid to eligible military (including Coast Guard), civilian, certain overseas employees, and non-appropriated fund employee homeowners who have served or have been employed at or near military installations which the Department of Defense (DoD) has ordered to be closed or whose operations have been significantly reduced and where real estate values have declined because of the announced closure or realignment. Section 1001 of the American Recovery and Reinvestment Act of 2009 expanded the HAP authority to authorize the Secretary of Defense to provide financial aid to: members of the Armed Forces (30% or greater disability) who incur a wound, injury, or illness in the line of duty during a deployment in support of the Armed Forces on or after September 11, 2001; wounded DoD and Coast Guard civilian homeowners reassigned in furtherance of medical treatment or rehabilitation or due to medical retirement in connection with a disability incurred in the performance of his or her duties during a forward deployment occurring on or after September 11, 2001 in support of the Armed Forces; and surviving Spouses of fallen warriors who move within two years of the death of such employee or member.
HAP is subject to the availability of funds as appropriated by Congress to the DoD for the program and will cease when all funds are expended. The U.S. Army is the DoD Executive Agent for administering the HAP, and the U.S. Army Corps of Engineers (USACE) implements the program for the Army.
At this time, applications are only being accepted from Wounded, Injured, or Ill and Surviving Spouse applicants. There is currently no HAP approved for BRAC Impacted Personnel.
Army Reserve Soldiers in Federal active duty, under the authority of Title 10, may be eligible to receive financial assistance through HAP if they meet program's criteria.
Wounded, Injured, or Ill member of the Armed Forces - Any member of the Armed Forces in medical transition who:
- Incurred a wound, injury, or illness in the line of duty during a deployment in support of the Armed Forces on or after September 11, 2001
- Is disabled to a degree of 30% or more as a result of such wound, injury, or illness, as determined by the Secretary of Defense; and
- Is reassigned in furtherance of medical treatment or rehabilitation, or due to medical retirement in connection with such disability.
In addition, the home for which HAP benefits are being requested must have been the applicant's primary residence at the time of the relevant wound, injury, or illness.
Surviving Spouses - A Spouse of a member of the Armed Forces or the United States Coast Guard may be eligible when:
- The Service member was killed in the line of duty or in the performance of his or her duties during a deployment on or after September 11, 2001, in support of the Armed Forces or died from a wound, injury, or illness incurred in the line of duty during such a deployment; and
- The Spouse relocates from such residence within 2 years after the death of such member or employee.

If an applicant is eligible under the Wounded, Injured, and Ill or Surviving Spouse categories and money is available, HAP may provide financial assistance under one of the following three scenarios: Private Sale, Government Acquisition, or Foreclosure:
- Private Sale: Benefit amount is the difference between 95% of the home's prior fair market value and the selling price. HAP may also reimburse the applicant for normal and customary seller's closing costs;
- Government Acquisition: Benefit amount is the greater of 90% of the home's prior fair market value OR the mortgage(s) payoff amount;
- Foreclosure: Benefit is paid to the lien holder for legally enforceable liabilities.
Applying for HAP Benefits
The basic application is made on DD Form 1607, Application for DoD Homeowners Assistance Program. Part III, Section IV of the form must be completed by your personnel officer. In addition, you must submit a variety of documents to show evidence of your ownership of the property, your occupancy dates, your assignment orders, your efforts to sell the home (whether it was sold), and mortgage details.
